There is a widely repeated myth that a sitting president cannot be criminally prosecuted. But here’s the truth:
It’s not a law. It’s not in the Constitution. It’s not even a court ruling.
It’s a Justice Department memo. Just internal policy. One written in 1973 during Watergate, another re-upped in 2000. That’s it.
And policies can change — especially when a president commits crimes, incites insurrection, or actively undermines democracy.
