No Trial, No Rights, No Republic: Trump’s Habeas Threat Must Be Stopped

Donald Trump is preparing to jail people without trial.
That’s not hyperbole. It’s not speculation. It’s the stated goal of the legal architects who helped him build the last coup attempt—and who are now laying the groundwork for the next one.
On Brian Tyler Cohen’s show, constitutional lawyer Marc Elias sounded the alarm. He cited a plan, floated by former Clarence Thomas clerk John Eastman and Trump-aligned circles, to suspend habeas corpus during Trump’s second term.
Elias didn’t mince words:
“It would be like a nuclear bomb going off.”
He’s absolutely right.
Because this isn’t just another bad idea. This isn’t tariffs or tweets. This is crossing the line from democracy into dictatorship.

What is habeas corpus—and why does it matter so much?
Habeas corpus is the right to challenge unlawful detention. It is the bedrock principle that the government cannot hold you indefinitely without due process. Without it, every dissenter, journalist, immigrant, protester—or simply unlucky citizen—can be locked up indefinitely, with no trial, no charges, no judge, no law.
It is not optional.
And crucially: It is not a presidential power.
Habeas corpus appears in Article I, Section 9 of the Constitution:
“The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.”
That’s Congress’s domain.
Not the president’s.
If presidents could suspend habeas corpus unilaterally, every autocrat would do it. That’s why the founders gave this power to the branch designed to move slowly: the legislature.

Impeachment takes time—and Trump knows how to stall it.
The 25th Amendment is faster. If Trump is threatening mass unlawful detention, ignoring constitutional boundaries, and descending further into paranoia, he is unfit to discharge the powers and duties of the presidency. That’s the exact standard the 25th sets.
It’s clean. It’s constitutional.
And honestly, it’s merciful.
Because here’s the alternative:

If Trump wants a soft landing, give him one:

Because just one incident—real or staged—will give him cover to declare martial law, suspend rights, and detain without trial. That’s why he must be removed before June 14. We are not dealing with policy disputes—we are facing a man preparing a trigger event, one that could unleash something irreversible.
Impeach him. Invoke the 25th. The Nixon treatment. Whatever path works fastest—take it.
And if you show up on June 14, come in peace. Come in massive numbers.
